Article 1 – Purpose and scope

These General Rental Conditions (hereinafter «CGL») govern the bookings for short-term seasonal rentals concluded between:

The Landlord : Philippe Cantegreil, private owner, operating the website www.rosesrentals.com, hereinafter referred to as «Roses Rentals».

The Tenant : Any adult natural person making a reservation on the Site or directly with the Lessor, hereinafter referred to as «the Tenant».

All bookings imply full and complete acceptance of these T&Cs. These conditions apply to the exclusion of any other document.

Article 2 – Description of the Housing

Roses Rentals offers two apartments for rent in Canyelles Petites, Roses (Costa Brava, Spain):

Apartment S1 – Sea view apartment with panoramic terrace, 2 bedrooms, maximum 4 people. Tourist licence: HUTG-010223-77.

Apartment S2 – Renovated sea-view apartment, Canyelles Petites, 2 bedrooms, maximum 4 people. Tourist licence: HUTG-066697-30.

The properties are described in detail on the corresponding pages of the Site. The Landlord undertakes that the properties shall conform to their description at the time of booking.

Article 3 – Booking and Formation of Contract

The booking can be made:

  • Directly on the website www.rosesrentals.com via the booking engine
  • By email to contact[@]rosesrentals.com
  • Via partner platforms Airbnb and Booking (the terms and conditions of these platforms will then apply jointly)

The booking is confirmed upon receipt:

  1. From payment of the deposit (see Article 4)
  2. From the written confirmation sent by email by Roses Rentals

Roses Rentals reserves the right to refuse any booking for a legitimate reason, in particular in case of unavailability or doubt as to the identity of the Renter.

Article 4 – Price and Payment Terms

Prices are shown in euros, all taxes included. They include: accommodation rental, charges (water, electricity, WiFi), household linen and a private parking space.

Payment terms for a direct booking:

  • A deposit of 50% of the total amount due at the time of booking
  • Balance of 50% of the total price payable 30 days before the arrival date


For any booking made less than 30 days before arrival, the full amount is payable upon booking.

Payment is made by bank card via the secure Stripe platform (SSL encryption). Roses Rentals does not have access to the full bank details of the Tenant at any time.

Roses Rentals reserves the right to amend its rates at any time. The applicable price is the one in force at the time of booking confirmation.

Article 5 – Caution

A deposit of EUR 500.00 per apartment is required on arrival, by bank card imprint or bank transfer. It will be returned within 7 days of departure, minus any damages found.

No deposit will be retained in the absence of damage.

Article 6 – Cancellation Conditions

Cancellation by the Tenant:

Cancellations must be notified by email to contact@rosesrentals.com. The date of receipt of the email will be considered proof.

The Tenant is strongly advised to take out cancellation insurance with their insurer or their bank card provider.

Landlord's Cancellation:

In the event of cancellation by them for reasons beyond their control (accident, force majeure), Roses Rentals undertakes to refund all sums paid within 14 days. No additional compensation may be claimed beyond this refund.

Article 7 – Arrival and Departure

Arrival: from 5:00 PM Departure: before 10:00 AM

Different timings can be agreed upon mutually, subject to availability. Access to the accommodation is via a secure key box, allowing for self check-in at any time.

Access instructions will be communicated by email within 48 hours of arrival.

Article 8 – Occupation and House Rules

The accommodation is rented to the Tenant named in the booking. Subletting and assignment of the contract are strictly forbidden.

The Tenant agrees to:

  • To occupy the dwelling as a good family man and to use it exclusively for residential purposes
  • Please observe the maximum occupancy indicated (4 people per apartment)
  • Do not organise parties or events without prior written agreement from the Landlord.
  • Respect the peace of the neighbourhood, especially between 10:00 PM and 8:00 AM.
  • No smoking inside the accommodation (terraces are permitted)
  • No pets to be introduced without prior written consent
  • Leave the accommodation in a satisfactory state of cleanliness upon departure
  • Report any malfunction or damage immediately.

Article 9 – Tenant's Liability

The Tenant is responsible for any damage caused to the accommodation, its furniture, and equipment during their stay. Any damage noted at the exit inspection will be deducted from the security deposit, and if necessary, will be subject to an additional charge.

The Tenant is invited to check that their civil liability insurance (home insurance or premium bank card) covers seasonal rentals abroad.

Article 10 – Landlord's Liability

Roses Rentals is committed to providing accommodation that is as described, clean, and in good working order.

In the event of a major defect affecting the habitability of the accommodation (serious breakdown, disaster), Roses Rentals undertakes to offer a replacement solution or, failing that, to refund the unused nights proportionally.

Roses Rentals shall not be held liable for any inconvenience caused by factors beyond its control, such as neighbourly works, weather conditions, occasional noise disturbances, or disruptions to public utilities.

Article 11 – Tourist Tax

In accordance with current Spanish regulations in Catalonia, a tourist tax (taxa turística) may be chargeable and will be collected separately according to the current rates set by the Generalitat de Catalunya.

Article 12 – Personal Data

personal data collected for the booking is processed in accordance with our Privacy Policy.

Article 13 – Governing Law and Disputes

These T&Cs are governed by French law. In the event of a dispute, and failing an amicable resolution, the French courts shall have sole jurisdiction.
